Job Responsibilities:
Draft, review and negotiate a wide variety of contracts, including agency/client agreements, vendor/production agreements, media contracts, talent agreements, confidentiality agreements, and intellectual property and music/content licenses.
Review proposed advertising and marketing materials to ensure compliance with federal and state laws, rules and regulations, as well as adherence to best industry practices. Advise agency personnel of potential risks (including copyright, trademark, right of privacy/publicity, promotions and consumer protection law) and additional materials needed for substantiation for claims, permission for talent, third party trademarks and copyrighted materials, etc., and additional disclosures.
Provide legal advice on an ongoing basis in areas of advertising law, claim substantiation, trademark clearance, copyrights, promotions, rights of privacy and publicity, user generated content, endorsements and testimonials, and social and mobile media.
Advise on production of commercial materials, including issues related to COVID-19 risks and legal compliance.
Educate, advise, and counsel agency personnel and management on legal issues affecting business decisions.
Provide periodic training to business units on legal process, advertising law basics, and key legal issues affecting operations.
Standardize templates, processes and legal guidance where possible to improve efficiency of legal services to business units.
Qualifications/Requirements:
JD degree from an ABA accredited law school
6+ years of relevant experience; previous in -house experience preferred
Must be in good standing with New York State Bar Association
