Thanks for using our Job search engine (Jobnub). This document contains our Terms of Service and Use. By accessing our Services, you are agreeing to these terms and conditions in full. Please read them carefully.

 

About the Services and the Terms:

 

I. Services

 

The Services allow users to, among other things, search for jobs, upload resumes, list jobs, search for resumes, sponsor jobs, advertise products, write reviews on companies, as well as rate companies. The Services may provide paid listings, advertisements or other sponsored information. The Services may also mix sponsored information with general, unpaid search results and may not distinguish between these two categories of information. Sponsored listings or other advertisements may also be given priority in display over unpaid listings.

 

II. Eligibility

 

To use the Services, you must be, and represent and warrant that you are, of legal age (16 years and over) and of legal competence to enter into a binding agreement with Jobnub, Inc., and are not otherwise prohibited from using or receiving the Services in accordance with these Terms of Services. By using the Services on behalf of any third party you are representing to us that you are an authorized representative of that third party and that your use of the Services constitutes their acceptance of these Terms of Services.

 

III. No Unlawful or Harmful use of the Services

 

You represent and warrant that your usage of the Services will only be for lawful purposes and will be done in accordance with these Terms, any applicable Service-Specific Rules, and all applicable laws generally. You also represent and warrant that you will not use any of the jobnub.com Web Pages or Services to violate any law, regulation or ordinance or any right of jobnub.com or any third party, including, without limitation, any right of privacy, publicity, copyright, patent or trademark or other intellectual property right.

 

IV. Changes to Terms.


Jobnub may periodically modify and supplement these Terms of Services, with or without notice to you. You are responsible for regularly checking these Terms of Services for revisions.

 

V. Terms for Registered Users

 

In order to take advantage of certain features of the Services (including, without limitation, the writing of reviews and rating of employers, searching of jobs, uploading of resumes, posting of jobs, advertisements, searching of resumes, and the receipt of newsletters and special offers from Jobnub.com), you may be required to create an account with Jobnub.com. You represent and warrant that all registration information provided by you in connection with accessing and/or using the Services is true, accurate, current and complete at the time of registration and you undertake to update all such registration information if at any time during your use of the Services it becomes untrue or inaccurate. Jobnub use of any Personal Information that you provide to Jobnub.com during the account creation process is governed by the Services Privacy Policy, which may be reviewed in our Privacy Policy Section of this document.

 

When you create an account, you agree to take full responsibility for maintaining the confidentiality of your Jobnub account username and password, and for all activity that is generated by your account. Accordingly, you understand and agree that you will be liable for any activity performed by any people using your Jobnub account. You agree to immediately notify Jobnub of any unauthorized use of your account or any other breach of security.

 

2. Using the Services

 

I. Grant of Rights

 

Subject to your compliance with these Terms, Jobnub grants you a limited, non-exclusive right to use the Services, including any content available to you via the Services, only as permitted in these Terms. The Jobnub.com Web Pages are for your personal, non-commercial use only.

 

II. Termination

 

Jobnub may terminate your access to the Services in whole or in part if it reasonably believes you have breached these Terms of Services, or any other related terms, guidelines or policies. Following termination, you will not be permitted to use the Services. If your access to the Services is terminated, Jobnub may exercise whatever means it deems necessary to prevent unauthorized access to the Services, including, but not limited to, technological barriers, IP mapping, and direct contact with your Internet service provider. These Terms of Services will survive indefinitely unless and until Jobnub chooses to terminate it, regardless of whether any account you open is terminated by you or Jobnub or whether you continue to use or continue to have the right to use the Services.

 

III. Intellectual Property Rights

 

Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. You may not use content from our Services unless you obtain permission from its owner or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our Services. Don’t remove, or alter any legal notices displayed in or along with our Services.

 

Our Services display some content that is not ours. This content is the sole responsibility of the entity that makes it available. We may review content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law. But that does not necessarily mean that we review content, so please don’t assume that we do.

 

IV. Prohibited Conduct

 

You may use the Services and any materials or content made available to you in connection with your use of the Services only as expressly permitted by these Terms of Services and only in a manner that does not interfere with Jobnub’s right or ability to provide the Services or any third party’s right or ability to use or enjoy the Services. Without limitation, you may not: (i) infringe, violate, or transgress any right of any party; (ii) attempt to bypass, disrupt or interfere with the security, provision or use of the Services; (iii) impersonate another person or entity, misrepresent your affiliation with a person or entity (including Jobnub Services), or use a false identity; (iv) attempt to obtain unauthorized access to the Services; (v) engage, directly or indirectly, in any type of unsolicited communication; (vi) collect, manually or through an automatic process, information about other users without their express consent or other information relating to the Services; (vii) submit false or misleading information to our search engine platform(Jobnub.com); (viii) violate any law, rule, or regulation; (ix) use any of our Marks or other portion of the Services (including in connection with meta tags or other “hidden text”) in advertising, promotions, or for other commercial purposes; (x) use the Jobnub.com or any domain name that is confusingly similar to this or another Jobnub domain name as a pseudonymous return e-mail address for any communications that you transmit from another location or through another service; (xi) link to or “frame” any Jobnub website (including deep linking to a specific portion of any Jobnub website) or overlay content on the Services; (xii) conduct script searches or use search results of the Services in a manner that results in the automated display of any material or other information on a third party website; (xiii) use the Services to compile information about a product or service for use in connection with a listing for a competitive product or service; (xiv) take any action that may undermine the ratings or review or similar process(es) under the Services; or (xiv) assist any third party in engaging in any activity prohibited by these Terms of Services. Jobnub reserves the right, but not the obligation, to monitor the Services for the purpose of determining that your usage is in compliance with Terms of Services.

 

V. Liability for our Services

 

When permitted by law, Jobnub will not be responsible for lost profits, revenues, or data, financial losses or indirect, special, consequential, exemplary, or punitive damages.

To the extent permitted by law, the total liability of Jobnub, and for any claims under these terms, including for any implied warranties, is limited to the amount you paid us to use the services (or, if we choose, to supplying you the services again).

 

In all cases, Jobnub will not be liable for any loss or damage that is not reasonably foreseeable.

 

VI. Privacy Policy

 

You agree that Jobnub may collect, use, and share your information in accordance with our Privacy policy (Please see section 2 of this document for privacy policy)

 

VII. Disclaimer of warranties
 

Jobnub provides the services on an “as is” and “as available” basis. Jobnub does not represent or warrant that the services, their use, any information provided in connection with the services: (i) will be uninterrupted or secure, (ii) will be free of defects, delays, inaccuracies or errors, (iii) will meet your requirements, or (iv) will operate in the configuration or with hardware or software you use. Jobnub makes no warranties other than those made expressly in these Terms of Services, and hereby disclaims any and all implied warranties, including without limitation, warranties of fitness for a particular purpose, merchantability and non-infringement. Jobnub makes no representation or warranty with respect to any third-party materials, information, goods, or services, whether received or accessed via any links provided by or in connection with the services or otherwise.

 

VIII. General

 

A. If this Agreement is with Jobnub, claims for enforcement, breach or violation of duties or rights under this Agreement will be adjudicated under the laws of the State of Texas, without reference to conflict of laws principles. If this Agreement is with a Jobnub affiliate, claims for enforcement, breach or violation of duties or rights under this Agreement will be adjudicated under the laws of the place of incorporation for such affiliate, without reference to conflict of laws principles. All other claims, including, without limitation, claims under or for violation of consumer protection laws, unfair competition laws, and in tort, will be adjudicated under the laws of your state of residence in the United States, or, if you reside outside the United States, under the laws of the country to which the subject jobnub.com Web Pages are directed. If this Agreement is with Jobnub website, you hereby irrevocably consent to the exclusive jurisdiction and venue of state or federal courts in Harris County, Texas, USA in all disputes arising out of or relating to this Agreement or the use of the Services. Use of the Services is unauthorized in any jurisdiction that does not give effect to all provisions of this Agreement, including without limitation this Section.

 

B. If for any reason a court of competent jurisdiction finds any provision or portion of this Agreement to be unenforceable, the remainder of this Agreement will continue in full force and effect. A printed version of this Agreement and any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Jobnub may assign this Agreement, in whole or in part, at any time with or without notice to you.

 

C. You may not assign this Agreement. Except as expressly stated herein, this Agreement constitutes the entire agreement between you and Jobnub, Inc. with respect to the Services and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and Jobnub with respect to the Services.

 

D. The section titles in the Terms are solely used for the convenience of the parties and have no legal or contractual significance.

 

E. Any failure by Jobnub to exercise or enforce any provision of the Terms does not constitute a waiver of such right of provision.
