Job Description



The IP Legal Group at Gilead is seeking an experienced brand protection attorney who is passionate about patient safety and thrives in a high-volume, fast-paced, and collaborative environment to join its team. Responsibilities will include providing legal advice and assisting in the companys anti-counterfeiting and brand protection activities, including addressing complex legal questions involving illicit online sales of prescription medicines.

Specific Responsibilities

* Provide legal advice relating to and in support of the companys anti-counterfeiting and brand protection activities and ensure compliance with internal policies and protocols.
* Identify and recommend trademark, copyright, and design patent filing strategies to support anti-counterfeiting efforts.
* Partner with and support other departments on anti-counterfeiting/product security issues.
* Initiate civil and administrative cases and support criminal actions filed against manufacturers and distributors of counterfeit and illegally diverted products.
* Gain and ensure alignment with senior management and relevant functions on specific matters and projects.
* Cooperate with law enforcement authorities in region of responsibility and manage relationship with relevant customs authorities.
* Coordinate regional brand protection activities, including the management of external counsel and service providers as appropriate.
* Manage and engage in online enforcement against illegal pharmacies and distributors, including working with service providers, industry collaborations and online platforms and initiating UDRPs and civil actions as appropriate.
* Manage trademark recordations with customs.
* Develop and deliver anti-counterfeiting trainings to internal stakeholders and to external law enforcement officers and customs authorities.

Essential Functions

* Work collaboratively with other members of legal departments as well as internal client departments.
* Willingness and ability to work with and coordinate activities with a large number of individuals across various departments domestically and abroad.
* Appropriately triage a workflow, setting appropriate priorities with clients and delivering results within reasonably agreed timelines.
* Demonstrate the ability to think creatively and devise solutions to challenging problems.
* Contribute to multidisciplinary and/or cross-functional projects and take responsibility for legal aspects of complex to moderately complex projects within the IP Legal team.
* Ability to work independently and as a team.

Knowledge, Experience and Skills

* Juris Doctorate from a nationally recognized law school.
* Admitted to practice law.
* 5+ years of experience in a full-time licensed trademark attorney role with a strong emphasis on anti-counterfeiting, IP enforcement, and product security.
* Experience in successfully initiating/managing civil cases and/or supporting criminal/ administrative actions related to counterfeiting.
* Combination of law firm and in-house experience preferred.
* Pharmaceutical industry experience preferred.
* Experience in online brand protection/product security enforcement, including background in working with online platforms to identify and disrupt suppliers of counterfeit products.
* Ability to manage and serve a wide range of client groups within the company by recognizing and responding quickly and pragmatically.
* Exceptional and demonstrated written and verbal communication skills.
* High proficiency in computer skills including Word, Outlook, Excel, PowerPoint, Adobe and Visio, etc.
