Job Description

Provides advice and counsel related to the various benefit plans of the Company, including qualified retirement, health and welfare, and non-qualified deferred compensation plans, along with providing advice related to privacy issues under federal and state law.

Selects and manage outside counsel representing Valero in legal proceedings, and where appropriate, appear directly as counsel, including responding to audits from the IRS, DOL and other agencies.
Advises regarding disputes or potential disputes, which have not risen to litigation.
Handles employee benefits and privacy matters where potential claims may be involved.
Receives and properly handles all employee benefits and privacy matters for which Valero receives service of process.
Evaluates and pursues indemnity or insurance coverage in appropriate circumstances.
Investigates and evaluates potential claims by the company, where appropriate.
Coordinates discovery, including the preparation of witnesses and the collection of documents and other information.
Ensure all employee benefit plans are compliant with applicable law.
Aid in the development of policies and practices to ensure compliance with federal, state and local privacy laws.
Serve as the Company’s HIPAA privacy officer.
Works closely and collaboratively with the appropriate departments within HR involved with the day-to-day administration of qualified retirement, health and welfare benefits and non-qualified deferred compensation plans, to address and provide effective guidance on compliance and administrative matters in accordance with ERISA, the Internal Revenue Code and other applicable laws
Coordinates drafting and review of employee benefit plan documents and amendments, as well as handbooks, communication materials and correspondence involving plan participants and/or third parties.
Coordinate and assists with review of benefit related agreements with benefit plan vendors and third party service providers.
Proactively monitors and analyzes changing laws and regulatory guidance that may be applicable to the Company’s employee benefit plans in order to provide practical advice and counsel, and partner strategically with the appropriate departments within HR to address interpretation, impact and compliance.
Provides legal counsel and support to the internal plan administrative committee relating to compliance with ERISA and related fiduciary matters, in coordination with HR, Treasury and other legal colleagues.
Provides support for corporate transactions from an employee benefit plan perspective
Provides support for other departmental responsibilities as needed.

This position is salaried exempt status, which means you are not eligible for overtime pay.

Qualifications

Bachelor's or higher level degree in a related field required.
Law degree from an accredited law school required.
Admitted to the practice of law in Texas or be otherwise eligible to practice law in Texas required.
5 years experience in legal practice is required.
Experience in relevant function with another major public corporation or a law firm preferred.
Experienced with federal and state privacy law preferred.
