Senior Counsel, Employment Law

Job Description

ESSENTIAL FUNCTIONS:

* Provide advice and counsel on all aspects of the employment relationship: hiring, background checks, performance management, employee discipline, employee relations, requests for accommodation, leaves of absence, individual terminations, reductions-in-force, relocation, independent contractor status, wage and hour, restrictive covenants, affirmative action, and others.
* Represent the Company in pre-litigation employment disputes - e.g., responding to demand letters.
* Design, draft and provide legal interpretation to Executive Compensation team on compensation plans and agreements, including consideration of 409A compliance.
* Provide advice and counsel on benefit issues including COBRA, 401k, severance, pension, and health plan issues. Work closely with IPG Benefits and outside counsel on plan documents, internal claims, and vendor agreements relating to benefit plans. Manage any benefits-related litigation.
* Support annual pay equity review - engage with statistician on regression analysis, provide legal advice to agencies re: results and next steps.
* Draft, review, and interpret employment policies, handbooks, and forms (e.g. form offer letter and separation agreement). Ensure compliance in states in which IPG operates (37).
* Work closely with cross-functional team (HR/Risk/Legal/IT) to develop and administer compliance training programs network-wide, including Code of Conduct, anti-harassment, and other specialty training programs. Periodically review vendor selection and work with team on RFP to find best partners for LMS and training content.
* Develop and deliver training on employment law topics (new developments and existing requirements) for various audiences - management/HR/employees.
* Represent the Company before state and federal administrative agencies, including the EEOC, state and local human rights agencies, Wage and Hour Division and OFCCP.
* Assist in managing and investigating employment-related complaints, including complaints of sex harassment and reports to the Interpublic Alertline.
* Work with IPG Communications re: press coverage of employee disputes or litigation.
* Represent agencies when enforcing restrictive covenants and when defending claims of breach or interference of same.
* Work with outside immigration counsel as needed.Assist with security issues involving employees; partner with security consultants as needed.

EDUCATION AND EXPERIENCE REQUIREMENTS:

* JD Degree from an accredited law school and top academic credentials.
* Membership in good standing with the New York state bar.
* At least 3-5 years of experience and proven track record in employment law counseling and litigation.
* Familiarity with major federal and state employment laws (e.g., Title VII, ADA, ADEA, FMLA, FLSA, WARN Act, paid leave laws, etc.).
* Excellent business judgment with a capacity to make decisions and give advice, which demonstrates an understanding of overall business objectives and the risks/rewards of each situation.
