Business Overview:

The NA Tax Operations Group is responsible for establishing operational procedures and controls to comply with IRS, FATCA, and AEOI regulations relating to US tax information reporting. Tax Operations governs the maintenance of tax documentation (e.g. Forms W-8 and W-9, CRS self-certifications), withholding and remittance of taxes to US Treasury, and issuance of annual 1099, 1042-S, 945, 1042 reporting to both external clients and the IRS. The group collaborates with Corporate Tax to assess the impact of new tax legislative, and engages with transversal resources to develop plans to respond and/or comply with new regulations. To the extent a new business process is required; Tax Operations develops business requirements and ensures that IT and operational procedures are enhanced to support regulatory change. The team is highly collaborative internally across BNP Paribas Corporate Institutional Banking Americas and externally with clients within the Bank. Tax Operations covers multiple business lines, functions, and regions within various BNP Paribas entities.

Responsibilities

Management of tax reporting, withholding, and documentation processing for Prime Brokerage business line in strict compliance with IRC Chapters 3, 4, 61, 871(m), 305(c), and FATCA regulations. Supervision of staff to ensure support of tax form collection during client onboarding/recertification, payment tracking and tax withholding processing, and submission of year-end 1099, 1042-S, 945, and 1042 reporting in line with regulatory deadlines. Oversight of existing controls policies, support of IT system enhancement. Essential duties and responsibilities include the following:

* Supervision of all tax documentation/reporting/withholding functions covering Prime Brokerage activities
* Management of frequent tax form re-certification for IRC chapter 3 and 4, and FATCA purposes
* Annual filing of IRS tax reporting extensions for select BNP Paribas entities
* Oversight of daily review and surveillance of account income and withholding payment activity
* Coordination with client onboarding and due diligence groups to ensure proper account tax documentation collection and tracking
* Analysis and coordination of new tax reporting requirement impacts on Tax Operations group and systems
* Development of compliance procedures in response to new tax initiatives
* Assurance that changes in the industry are properly communicated to business/IT groups and implemented by required deadlines
* Research of client tax form correction requests regarding reclassifications, foreign tax withholding and other tax related issues
* Coordination of all yearend tax information for activities/products in scope and reporting of this information in accordance with IRS requirements
* Reconciliation of yearend reports versus weekly IRS deposits
* Assistance to BNPP global network of Qualified Intermediaries in fulfillment of tax reporting and filing requirements.
* Drafting of supervisory procedures
* Supervision of staff daily controls and regulatory reports

* Assistance with regulatory projects and development of controls necessary to implement new tax rules, and regulations and ensure compliance within those rules

* Identification and participation in process design to achieve better controls, compliance and efficiency

* Review of Tax Operations policies supporting various businesses, performance of gap analysis , and drafting of business remediation plans

* Support of audits with IRS and Internal Audit (IA), and any other special audits

* Review, validation, and processing of W-8 and W-9 tax forms and related documentation according to IRS Chapter 3, chapter 61, and FATCA regulations

* Support of technology and system migration projects

* Contribution towards departmental obligations to adhere to strict regulatory and compliance requirements, per IRS and BNP Paribas policy

* Review of written tax policy and procedures, analysis, and response to inquiries from operational areas and central teams

* Management and drive of employee engagement and talent management

Minimum Qualifications:

* Bachelor's degree in Accounting, Finance, Business or similar.
* 4 - 6 years tax information reporting, withholding and tax document management experience in Prime Brokerage
* Understanding and expert knowledge of IRS Forms W-9 and W-8 and their associated requirements; Forms 1099 series, 1042-S; Forms 945 and 1042
* Strong knowledge of Income Sourcing rules
* Highly ethical and control oriented
* Strong team and leadership skills
* Innovative and adept at assessing process improvement
* Strong knowledge BPS tax reporting software
* Excellent knowledge and understanding of tax accounting rules and regulations
* Knowledge of Broadridge systems/products
* Experience in the development and deployment of reporting systems / tools
* Understanding of system requirements and capabilities to ensure appropriate controls and processes
* High Proficiency in standard Microsoft applications including Excel
* Strong communication, multi-tasking, analytical, and organizational skills
* Solutions-oriented thinker who is able to generate creative ideas
* Effective analytical, organizational, and problem-solving skills
* Prior management experience (small team of 3)

Preferred Qualifications:

* Knowledge of Broadridge TMS (Tax Managed Services) system
* Proficiency in MD3 validation software
